Dr. Food® Privacy Policy

This Privacy Policy explains how we collect, use, disclose, and safeguard your information when you use our mobile application "Dr. Food" (the "App"). The App is designed to track your nutritional intake, hydration, and encourage healthy habits and lifestyle changes to promote weight loss and enhanced physical fitness.

 

Please read this Privacy Policy carefully. By downloading, accessing, or using the App, you agree to the terms of this Privacy Policy. If you do not agree with the terms of this Privacy Policy, please do not access or use the App.

You are advised to review this Privacy Policy periodically for any changes. Your continued use of the App after the posting of changes constitutes your acceptance of such changes.

We collect information that you provide directly to us, information collected automatically, and information from other sources. The types of information we collect depend on how you interact with the App.

We do not collect data from children under 13 without verifiable parental consent, in compliance with the Children's Online Privacy Protection Act (COPPA). If we learn we have collected such data without consent, we will delete it promptly.

  1. To Provide and Improve the App: To track your nutritional intake, hydration, and health habits; generate personalized recommendations for weight loss and fitness; and enable features like progress reports and habit reminders.

We do not use health data (e.g., from HealthKit) for advertising, marketing, or any other purpose unrelated to improving your health experience, unless you provide explicit permission for health research.

  1. Analytics and Research: To analyze usage patterns, improve app performance, and develop new features. This may involve de-identified or aggregated data.

 

  1. Security and Fraud Prevention: To detect and prevent abuse, fraud, or security incidents.

We only collect and use data that is necessary for these purposes. Health and fitness data is processed on your device where possible to minimize transmission. We do not write false or inaccurate data into HealthKit or any health management systems, and we do not store personal health information in iCloud.

  1. Service Providers: With third-party vendors who assist us in operating the App, such as cloud storage providers, analytics services (e.g., Google Analytics), or payment processors. These providers are contractually obligated to use your data only for the services they provide to us and to protect it equivalently to this Privacy Policy.

 

  1. Affiliates: With our corporate affiliates for internal business purposes.

 

  1. Legal Requirements: If required by law, such as in response to a subpoena, court order, or government request; to enforce our terms; or to protect the rights, property, or safety of us, our users, or others.

We do not share health, fitness, or medical data with third parties for advertising, marketing, or data mining purposes. Any sharing for health research requires your explicit permission. We require all third parties to maintain the confidentiality and security of your information.

 

For tracking across apps and websites owned by other companies, we use Apple's App Tracking Transparency framework and only track with your permission.

For example, we use encryption for data in transit and at rest, access controls, and regular security audits. However, no method of transmission over the internet or electronic storage is 100% secure, so we cannot guarantee absolute security. While we strive to use commercially acceptable means to protect your personal information, we cannot guarantee its absolute security against all risks, including cyberattacks, data breaches, or unauthorized access by third parties. By using the App, you acknowledge and agree that you provide your information at your own risk and that we are not responsible for any unauthorized access to or use of your information that occurs despite our reasonable security measures.

 

In the event of a data breach or security incident involving your personal information, we will notify you and relevant authorities as required by applicable laws (e.g., CCPA or GDPR). However, to the fullest extent permitted by law, we disclaim any liability for damages, losses, or harms arising from such incidents, including but not limited to theft, unauthorized disclosure, or misuse of your data by third parties.

If you are located outside the US, your information may be transferred to, stored, and processed in the US, where data protection laws may differ from your jurisdiction. By using the App, you consent to this transfer. We ensure appropriate safeguards, such as standard contractual clauses, for international transfers.

The App is not intended for children under 13. We do not knowingly collect personal information from children under 13. If we become aware of such collection, we will delete the information. For users under 16 in certain jurisdictions (e.g., EEA), we may require parental consent.

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, IN NO EVENT SHALL COOL INC., ITS AFFILIATES, OFFICERS, DIRECTORS, EMPLOYEES, AGENTS, SUPPLIERS, OR LICENSORS BE LIABLE FOR ANY INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES, INCLUDING WITHOUT LIMITATION, LOSS OF PROFITS, DATA, USE, GOODWILL, OR OTHER INTANGIBLE LOSSES, RESULTING FROM (I) YOUR ACCESS TO OR USE OF OR INABILITY TO ACCESS OR USE THE APP; (II) ANY CONDUCT OR CONTENT OF ANY THIRD PARTY ON THE APP; (III) ANY CONTENT OBTAINED FROM THE APP; (IV) UNAUTHORIZED ACCESS, USE, OR ALTERATION OF YOUR TRANSMISSIONS OR CONTENT, INCLUDING ANY DATA BREACH, CYBERATTACK, OR SECURITY INCIDENT; OR (V) ANY OTHER MATTER RELATING TO THE APP, WHETHER BASED ON WARRANTY, CONTRACT, TORT (INCLUDING NEGLIGENCE), OR ANY OTHER LEGAL THEORY, WHETHER OR NOT WE HAVE BEEN INFORMED OF THE POSSIBILITY OF SUCH DAMAGE, AND EVEN IF A REMEDY SET FORTH HEREIN IS FOUND TO HAVE FAILED OF ITS ESSENTIAL PURPOSE.

 

IN NO EVENT SHALL OUR AGGREGATE LIABILITY ARISING OUT OF OR RELATED TO THIS PRIVACY POLICY OR YOUR USE OF THE APP EXCEED THE GREATER OF ONE HUNDRED U.S. DOLLARS (U.S. $100.00) OR THE AMOUNT YOU HAVE PAID US IN THE PAST TWELVE (12) MONTHS FOR THE APP OR RELATED SERVICES. THE FOREGOING LIMITATIONS SHALL APPLY EVEN IF YOUR REMEDIES UNDER THIS PRIVACY POLICY FAIL OF THEIR ESSENTIAL PURPOSE.

 

Some jurisdictions do not allow the exclusion or limitation of incidental or consequential damages, so the above limitations or exclusions may not apply to you. This section shall survive any termination of your use of the App.
